Security aspect more important: HC on parking under flyovers

A division bench headed by Justice D D Sinha was hearing the public interest litigation (PIL) filed by businessman Rajbhoj Torne challenging the government's decision prohibiting parking under flyovers.

Additional government pleader Vijay Patil informed the court that the decision was taken by the government considering security issues and threat perceptions.

"As far as security is concerned, there cannot be any compromise. Convenience of citizens is important, but it doesn't override the security aspect. Flyovers are now a lifeline of our city. If the government perceives threat to it, then parking cannot be allowed," Justice Sinha observed.

The court has, however, asked the government and MSRDC to state the mechanism it proposes to evolve for ensuring the strict implementation of 'No Parking' policy in the future.

"Legally, you may have prohibited it. But you have to ensure that it is being followed," the judge said.

The government and the MSRDC have been asked to file a detailed affidavit within four weeks regarding this.
