Software specialist awarded Rs 15.94 lakh compensation

An infotech employee aged around 37 who sustained severe injuries in a road accident way back in 2005 and had claimed a sum of Rs 30 lakh has been awarded a compensation of Rs 15.94 lakh by the Motor Accident Claims Tribunal here.
Judge S Y Kulkarni presiding over the tribunal ordered the two respondent owner of a car, Subhada Vinayak Jain and the Tata AIG General Insurance Ltd, to pay compensation to the claimant Baby Bhaskaran Thekkudukkathu, then employed with Patni Computers, along with seven per cent interest from July 2006, the date of filing of the claim.
"On account of injuries which the applicant sustained he would definitely face difficulties to some extent and the percentage of disability will affect his functional capacity to some extent. Therefore, I am of the view that a lumpsum amount Rs 5,00,000 must be granted to the applicant towards loss of income and future prospective loss of income, the judgement said.
"Considering oral as well as documentary evidence on record and several bills which are placed on record I am of the view that total amount Rs 3,96,991 can be granted to the applicant for hospital and medical expenses. Considering the nature of injuries age at the time of accident, an amount of Rs 1,00,000 was granted as compensation towards pain and suffering," the judge said.
The applicant was also granted Rs 3,12,500 towards actual loss of income for the period which he was absent from duty, Rs 2,00,000 towards loss of enjoyment of life and amenities in future, Rs 25,000 towards attendant charges, Rs 15,000 towards special diet, Rs 20,000 towards conveyance, Rs 25,000 towards future medical expenses, in all adding up to Rs 15,94,491.
