The FIR was lodged late last night against the former Sheikhpura SP Babu Ram without mentioning his name, Mantu Singh, the business associate of the trader Mukesh Kumar and others, Bhagalpur Zone Inspector General of Police Jitendra Kumar said today.
It has been registered under sections 323 (punishment for voluntarily causing hurt), 324 (voluntarily causing hurt by dangerous weapons), 341 (punishment for wrongful restraint) and section 34 (acts done by several persons in furtherance of common intention) of the Indian Penal Code, he said.
The FIR was lodged on the basis of the statement made by the trader to the police at Patna Medical College and Hospital (PMCH) where he is under treatment, Kumar said.
Further investigation into the incident is on and necessary action would be taken, he said.
ADG (Headquarter) Ravindra Kumar, who is part of a two-member inquiry team, said the probe report in the incident will be submitted to the state government by this evening or tomorrow morning.
The trader was allegedly assaulted after being detained by policemen on January 25 and taken to the official residence-cum-office of the former SP. When his condition deteriorated, he was admitted to PMCH late that night.

Taking serious view of the incident, Chief Minister Nitish Kumar had yesterday ordered Ram's removal and transferred 12 policemen posted at Barbigha police station.
Meanwhile, the condition of the trader, who is in the intensive care unit of PMCH, is stable, doctors attending him said.
