Sufficient evidence against two lawyers, accused of abusing and manhandling persons from the Northeast including a woman advocate, has been found, the city police today told the Delhi High Court.
The High Court, which had earlier issued show cause notices to the lawyers, today asked Delhi police to serve the contempt notices on alleged contemnor advocates, Azad Chandra Prakash Gautam and Varun Jain, and fixed the plea for hearing on September 12.
Delhi police, in a status report, said that "during the course of investigation, sufficient evidence against accused Varun Jain ...And accused Azad Chandra Prakash Gautam... Came on the file" and a charge sheet against them has been filed before a court of Metropolitan Magistrate in Tis Hazari district court.
The lawyers have been booked under the IPC for offences including rioting, crime committed by a member of unlawful assembly, voluntarily causing hurt, wrongfully restraining a person, assaulting a woman and criminal intimidation, police said in the report.
The victims identified the accused with the help of photographs taken by a person inside the Tis Hazari courts complex on May 23, the date of incident, the report said.
The accused lawyers have been "thoroughly interrogated' during the probe and were released on bail after their arrest, the report, filed by the SHO of Subzi Mandi police station here, said, adding that the lawyers later refused to undergo the test identification parade (TIP).
A bench, headed by Chief Justice G Rohini, had earlier issued show cause notices to the two lawyers asking them why criminal contempt proceedings should not be initiated against them.
"Having regard to the facts and circumstances, this court is prima facie satisfied that the alleged acts against the respondents (two lawyers) are of such nature prejudicing and interfering with the due course of judicial proceeding and administration of justice.
