The emergence of golf club theory in Aarushi-Hemraj murder

There was no golf club theory in the Aarushi-Hemraj murder case before October 2009, when the case was handed over to the Special Investigating Team (SIT) headed by A G L Kaul.
SIT's contention is that Dr Rajesh Talwar brutally hit Aarushi's forehead and Hemraj's head with his golf club after finding them in a compromising position in his daughter's bedroom.
Both, Rajesh and his wife Nupur Talwar, were today held guilty of killing their 14-year-old daughter Aarushi and domestic help Hemraj in their house in Noida. While Aarushi was killed on the intervening night of May 15-16, 2008, Hemraj's body was found the next day.

CBI said that V-shaped injury on Aarushi's forehead could only have been inflicted with the attack of golf club as this injury matched with striking surface of golf club.
Dr Sunil Dohre and Dr Naresh Raj, who conducted post mortem examination on Aarushi and Hemraj's bodies respectively, reached this conclusion that injuries being seen on deceased are possible with golf club.
To establish its theory, SIT on September 25, 2009, approached Dr Mohinder Singh Dahiya, director of Gujarat Forensic Science University (GFSU) for preparing a report on crime scene analysis.

Dahiya along with CBI officials on October 9, 2009, inspected Talwars' Noida residence.

However, defence was claiming that Dahiya never visited Talwars' house and prepared his report on the basis of 14 photographs relating to scene of crime and deceased, 161 statements of some prosecution witnesses, Dr Sunil Dohre, who conducted postmortem examination on Aarushi's body, and investigating officer of this case.
On October 26, 2009, Dahiya submitted his crime scene analysis report in which he clearly said that crime was possibly committed using a golf club and surgical blade, and that no outsider except the dentist couple was involved in the murder. Dhahiya also added that Aarushi and Hemraj were murdered in Aarushi's bed.

After Dahiya's report, CBI's probe team on October 29, 2009, sent notice to Talwars under Section 91 of the CrPC to produce golf clubs. Next day, Talwars provided a set of dozen golf clubs to CBI which sealed all clubs.
CBI also referred to the examination conducted by D K Tanwar, scientist of the CFSL, who had found two golf clubs - iron golf club No 4 and a wooden golf club No 5 - seemed cleaner than the others during examination, (an indication, as per CBI's theory, that the alleged murder weapon was cleaned by the accused to destroy evidence).

Probe agency called, on August 2, 2010, Dr Rajesh Talwar's driver Umesh to the CBI office in Delhi for the Test Identification Parade (TIP) of two golf clubs which he had put in Hemraj's room in January, 2008.
As per CBI's theory, Rajesh picked up one of two golf clubs from Hemraj's room to hit Aarushi and the domestic help.
On the other hand, Talwars' theory was that as per Supreme Court's ruling, TIP should be conducted before magistrate and only then TIP would be admissible.
But, CBI officials conducted this test before them, which was not reliable.
Defence's theory was that in forensic test of golf clubs, no biological fluid, no DNA and no blood were found on them.

Besides, post mortem reports of Aarushi and Hemraj even don't suggest that victims were attacked with golf club.
CBI probe officer A G L Kaul had in April, 2013 said before the court that dentist couple slit Aarushi and Hemraj's throats with a sharp-edged weapon (surgical scalpel).
