:Madras High Court bench today granted bail to three accused included in a case registered for planting Improvised Explosive Device under a bridge at Almatti, targetting BJP leader L K Advani during his "Jan Chetna Yatra" on October 28 2011.
Justice R Mala granted conditional bail to Syed Sahabuddin, Darvish Moideen, and Mustafa and directed them to sign before Tiruchi Judicial Magistrate I till further orders.
Petitioner Sahabuddin contended he was a bag shop owner and the fifth accused was just his customer and there was no other relationship between them. He had also cooperated in the investigation for the past one and a half years.
He alleged that CB-CID police had collected a thread and a bag from his shop, purchased from North India, where old magazine papers are used for packing and used the material to foist the case.
Darvish said he was convicted in another bomb planting case and released in 2007 after seven years of imprisonment and was now leading a peaceful life. However his name had been included in the case just because he was the brother of Fakruddin, the main accused in the Pipe bomb planting case.
He alleged that police were taking revenge him because he filed a case against them through his wife on illegal detention and ill treatment.
Mustafa also charged police with having included his name in the case without proper material.
Police said the IED was recovered from under a bridge on Oct 28 2011 at Alampatti, cases registered against six persons and a chargesheet filed. Three of them, including Fakrudeen, Bilal Malik and Mohammed Haniba are absconding.
CB-CID, which took over the case, included three more and they had been granted bail today.
