Additional Sessions Judge Virender Kumar Goyal sentenced Delhi resident Alok (29) to seven years in jail for the offence of robbery with an attempt to cause death/grievous hurt under section 397 of IPC, and Jitender(30) and Ashish(23) to five years rigorous imprisonment for the offence of voluntarily causing hurt in committing robbery under section 394 of the IPC.
"Prosecution has been able to prove offences (of the accused) beyond reasonable doubts..." the judge said, while relying on the statement of victim Harsh Chauhan, who was injured and robbed off his belongings in 2010.
While awarding the sentence to the three persons, the court also imposed a fine of Rs 2,000 each. Besides the fine, it directed them to pay Rs 5,000 each as compensation to the victim.
According to the prosecution, on the night of May 29, 2010, when Harsh was walking towards his house near Keshav Puram here, Jitender, Alok and Ashish, who were on a bike, attacked him from behind and robbed him of his mobile phone, silver ring and some cash.
From the bike number, police apprehended its owner Jitender, who was identified by Harsh, and later Alok and Ashish were also arrested.
They all claimed innocence and sought leniency from the court on the ground that they were young and were the soul bread earners of their families.
