The transfer of the murder case of Suresh Kumar, an activist of Madurai-based Hindu outfit from a court here to a special court in Poonamallee near Chennai has been challenged by a suspect's mother.
In her petition, A Beema Dowlath said her son Toufeeq Ali was arrested on August 8, 2013 in connection with the murder and the case was then handed over to CB-CID for probe.
She contended that Toufeeq was arrested as police could not nab two other key suspects "police" Fakrudeen and Bilal Malik then.
Noting that Suresh Kumar was not a cadre of any Hindu organization, she claimed that he was murdered owing to an enmity over a temple festival and other personal issues.
The case pending before a Madurai court, was transferred to the designated special court for bomb blast cases at Poonamallee on August 5, she said, adding it was an unnecessary transfer as there was no allegation of any explosives being used in the murder of Suresh Kumar.
Dowlath wanted the court to quash the transfer order and consequently direct the CB-CID to proceed with the case at the judicial magistrate-IV court in Madurai.
Justice V Ramasubramanian directed the government advocate to get instructions by November 5.
