Two get life term for fatally stabbing man to steal mobile

Two youths have been sentenced to life imprisonment by a court here for fatally stabbing a man while robbing his mobile phone in 2010.
Additional Sessions Judge Virender Kumar Goyal, while relying on the statements of the eye witnesses, handed down the jail term to Delhi residents Rajesh and Rajender for killing Neeraj, who was sitting in a park with his friend Anita, when he resisted their robbery bid.
"According to Anita (eye-witness), she saw that Rajender had stabbed Neeraj with knife, whereas Rajesh had held Neeraj which proves that in furtherance of their common intention, both committed murder of Neeraj," the judge said, while relying on Anita's testimony, which was corroborated by another eye-witness.
The court convicted both the youths for the offence of murder(section 302) with common intention. Separately, they were also convicted for the offences of attempt to commit robbery (section 393) and for robbery with attempt to cause death or grievous hurt (section 397) under the IPC.
It also directed Rajender and Rajesh to pay a compensation of Rs 75,000 and Rs 50,000 respectively to the parents of the victim "on account of physical or mental harm, including pain, suffering and emotional distress caused to his family".
However, while noting that the youths were incapable of paying the compensation, the court referred to Delhi Legal Service Authority for compensation in favour of Neeraj's parents under victim compensation scheme.
The court, while holding them guilty, also relied on the post mortem report of Neeraj according to which the "nature of injury was sufficient to cause death" as he had suffered two knife-blows on his chest.
