Two persons get 4-yr jail term for robbing lunch box, watch

Two persons, arrested for robbing a man of his bag containing his lunch box and a wrist watch here last year, have been sentenced to four years imprisonment by a Delhi court.
Additional Sessions Judge Hemani Malhotra held accused -- Bhawani Shankar and Vikas Pahari -- guilty of the offences under Section 392 (robbery) along with Section 34 (common intention) of the IPC.
"I have no hesitation to hold that the prosecution has been successful in proving the guilt of the accused Bhawani Shankar and Vikas under Section 392 read with Section 34 IPC beyond reasonable doubt," the judge said and also imposed a fine of Rs 1,000 each on the two convicts respectively.

The court, while convicting 37-year-old Shankar, relied on the testimonies of victim Sonu and a policeman, who had nabbed him, saying "his arrest from the spot and recovery of the tiffin box and bag only proves his guilt beyond reasonable doubt."
"The witness (Sonu) stood his ground regarding the incident. Nothing has come on record impeaching his credibility," the court said.
On November 3 last year, Sonu, who was employed at a shop in Chandni Chowk, was walking towards the bus stop at Kashmere Gate when three persons blocked his way and robbed him of his bag which contained a wrist watch and a lunch box that he had received as Diwali gift from his employer, police said.

According to an FIR lodged with the police, Shankar and Vikas had snatched Sonu's bag while the third person, who is absconding, had pointed a knife towards him.

Shankar was arrested from the spot by a police official who was patrolling in the area while Vikas was apprehended few days later.
During the trial, both Shankar and Vikas had denied all the allegations levelled against them.
The court, however, convicted them while relying on the evidence brought before it and also observed that during the probe wrist watch of Sonu, which was robbed, was recovered from Vikas, who was nabbed two weeks after the incident.
