Uber cab rape: Court waiting for case file from SC

For the second time in a week, a Delhi court had to put off hearing final arguments today in the Uber cab rape case, in which a woman executive was allegedly raped by the driver last year, as it did not receive the case file and other records from the Supreme Court.
Additional Sessions Judge Kaveri Baweja fixed September 24 for hearing final arguments in the case on a day-to-day basis, when it is expected to receive the case file.
The court had on September 15 put up the matter for today as the case records were in the Supreme Court.

The apex court on September 10 had set aside the Delhi High Court order allowing the accused driver to recall and re-examine 13 prosecution witnesses, including the woman.
The apex court had also vacated its stay on the trial court proceedings which were suspended by its March 10 order.
According to the prosecution, the incident took place on the night of December 5 last year when the 25-year-old victim, a finance executive working in Gurgaon, was heading back home.

Police had said the woman had taken the taxi from Vasant Vihar to return her house in Inderlok area of North Delhi but accused Shiv Kumar Yadav took another route ad allegedly raped her. Yadav was arrested on December 7, 2014 from Mathura and is presently under judicial custody.

The court has framed charges against Yadav under IPC for alleged offences of endangering a woman's life while raping her, abducting with an intent to compel her for marriage and criminally intimidating and causing hurt.
The court had also recorded the testimony of the accused in which he termed the charge against him as "false".
