Holding Bhasin Motors India Pvt Ltd guilty of rendering deficient service to complainant Anil Shankar by offering him an used car in place of a new one after accepting his money, the New Delhi District Consumer Disputes Redressal Forum asked the dealer to pay the compensation to Shankar.
"We hold opposite party-2 (Bhasin Motors India Pvt Ltd) guilty of deficiency in offering an already used car in place of new, after accepting the money. He (Shankar) has already cancelled the booking. We award compensation of Rs 10,000 to complainant (Shankar)," the bench presided by C K Chaturvedi said.
In his complaint against the authorised dealer and the Volkswagen Motors India Pvt Ltd, Shankar had said he had paid the full price of the car while booking it, but when he went to pick up the vehicle from the showroom, he found that it had already been driven for 657 km already.
The dealer had not given him any explanation for the same, he had said. Even before the forum, the dealer did not explain as to how a used car was offered to Shankar.
