We are a company not society, says HPCA

Himachal Pradesh Cricket Association today submitted written and oral arguments before Registrar of Societies, saying it had no jurisdiction over the cricket body which was a company registered under Companies Act.
Registrar Cooperative societies, R D Nazeem said that he had heard the written and oral arguments and would pass the necessary orders.
The Registrar had served a show cause notice on the HPCA asking it to explain that how the HPCA registered under Societies Act had been converted into a company.
The HPCA challenged the show cause notice in the High Court, which directed it to appear before the Registrar for deciding the issue of Jurisdiction.
The HPCA remained consistent on its stand from the beginning that it was a Company and the registrar had no jurisdiction to serve the show cause notice.
The HPCA strongly justified its action of converting Society into a non-profit company nearly a year back, after having taken permission of the BCCI.
Appearing for the HPCA, R K Bawa, a former Advocate General and Vikrant Thakur, advocate asserted that before converting it into a company, the cricket body had informed the registrar about resolution passed by the body on September 22, 2012.
However, there was no mention whether the Registrar had approved the proposal of HPCA to convert the society into a Company.
