However, no man, accused of rape, can be convicted if the witnesses do not support the prosecution case as in the present case." It said the courts are "not to be swayed by emotions and reporting in the media." The prosecution case was that on May 9, 2012 the alleged victim had been employed at Sharma's residence by a placement agency at Rs 4,000 per month. Dissatisfied with her work, Sharma and his wife used to beat her up and on May 22, 2012 she phoned the police and complained about the beatings. The police called some NGO officials to counsel her and went on to register a case of rape against Sharma. The woman, however, told the court that she was made to sign a blank paper by the police and denied having ever told the police or the NGO about being raped. In her cross-examination also, she admitted having told the NGO workers about non-payment of salary. She also told the court that she had even told the police that she was never raped by Sharma.
