Guardian Judge Gautam Manan denied the man even the rights to visit his 15-year-old son and 11-year-old daughter, saying he has not paid them and their mother the maintenance, awarded by another court.
"Since December 2005, the minors have remained in the custody of respondent woman and have been groomed well and are getting good education in a good school. There is nothing on record to suggest that the respondent has ever neglected their welfare," the court said.
While dismissing Central Delhi resident's plea for the custody of children, the court said his job timings are from 9 am to 8 pm and he is unable to explain as to who will take care of the children in his absence.
The judge said during an interaction with the kids, they had also wished to reside with their mother who was bringing them up with her parents' support.
The man said he had married the woman in 1996 and their first child was born in 1997. He alleged his wife reiterate her demand for a separate house from his parents and was also negligent towards the health and studies of the children.
He alleged in 2005, she left her matrimonial house and took the children to her paternal house.
The man also said his wife had lodged false criminal case against him and their divorce petition is pending in a court here. He alleged the woman was not taking the children's studies seriously and she does not send them to school regularly. He said though the children are willing to meet him but the woman does not allow them. (MORE)
