While issuing the contempt of court notice to the woman, Justice Vipin Sanghi also imposed a cost of Rs one lakh on her and asked her to pay it to her husband within four weeks.
"I hold the respondent (prima facie) guilty of contempt of court as she has breached her undertaking to the learned additional district judge (ADJ) on September 14, 2010 in the first motion divorce proceedings under Section 13-B(1) of the Hindu Marriage Act," said Justice Sanghi, while admitting a Delhi resident's contempt of court plea against his wife.
"The agreement arrived at between the parties does not only deal with the aspect of divorce, to be obtained by mutual consent, but also with the aspect of custody / visitation rights of the minor child.
"Admittedly, the respondent (wife) has breached the said arrangement as well, and consequently, breached her undertaking to abide by the arrangement with regard to the custody and visitation rights of the minor child," said the court, while imposing the cost on her.
The court issued the contempt notice to the woman on her husband's plea that he had agreed to give Rs seven crore to her as one time settlement and even paid Rs 1.5 crore to her initially after which she gave an undertaking to the lower court for divorce with mutual consent. (MORE) PTI PNM RAX
