The child, part of a ski school group on the slopes of Hochhaderich mountain near German border, allegedly made a sudden turn into the path of the woman, who according to her lawyers, can no longer ski as a result.
The woman is taking legal action to seek 38,000 euros (USD 42,000) in damages from the child after the courts dismissed an earlier attempt to sue the adult who was supervising the child at the time of the accident, The Telegraph reported.
Under Austrian law, children under the age of 14 cannot be held responsible in a civil cases except for an exception where a child is capable of understanding the consequences.
At an initial hearing this week, a court expert testified that neither the adult woman nor the child were paying proper attention before the accident, the report added.
