Writ appeal filed by suspended by CAO of IIMB dismissed

A Division Bench of the Karnataka High Court today upheld a single's judge's order dismissing the petition of a senior official of Indian Institute of Management, Bangalore, challenging his suspension for alleged sexual harassment of a medical officer.
The bench headed by Chief Justice D H Waghela dismissed the appeal on the grounds that they would not interfere with the single judge's order of dismissal of the petition filed by Chief Administrative Officer C V Indu Skekar Vassist challenging his suspension.
It directed Vassist to go back to the Institute wherein the IIMB Director would take a final call on the matter.
However, the court stated that in case the decision taken goes against him (Vassist), he has the opportunity to challenge the order before an appropriate forum.
The court observed that in case the decision taken by the Institute goes against Vassist, the order be kept in abeyance for one week.
Earlier, in pursuance to the court's direction, Vassist had filed his reply to the show cause notice issued by the Institute as to why he should not be suspended.
The IIMB had placed Vassist under suspension from Nov 29, 2012 after the Gender Sensitivity Committee gave a report.
Vassist later filed a petition challenging his suspension which was dismissed by Justice Ravi V Malimath terming it as "premature". He then filed a writ appeal challenging the single judge's order.
