Youth acquitted of charges of outraging girl's modesty

Metropolitan Magistrate Savitri let off Delhi resident Suraj saying the girl has not supported her complaint upon which the prosecution case is based.

"I have seen that the prime witness (complainant) of the prosecution failed to support the case and she resiled from her previous statement.

"As the prime witness of the prosecution did not support the contents of the complaint on which the entire case of the prosecution rested, there is nothing incriminating against the accused," the court said.

It also said the alleged victim has "not identified the accused, who was present in the court and stated that she does not know the accused."

As per the prosecution, the incident took place last December when the accused had misbehaved with her on her way back home from a polytechnic where she was pursuing a course.

Suraj allegedly had pulled the girl's 'chunni (scarf) and then her hair as she was riding back home on a rickshaw. As she raised an alarm, the passersby got hold of the accused and beat him up before handing him over to the police.

The court, however, freed Suraj saying "she (girl) did not know whether the name of the accused was Suraj".
