The tribunal directed Oriental Insurance Company Ltd, with which the offending vehicle was insured, to pay a total of Rs 27,59,281 as compensation to Najafgarh resident Vikram Singh as he became permanently disabled due to the injuries suffered in the accident. The amount also includes Rs 18,000 for repairing of his motorcycle's damages.
MACT presiding officer Arun Bhardwaj said the charge sheet filed by police against the truck driver suggests that it was a case of rash and negligent driving and also "there is nothing on record to show that the claimant (Vikram) had any enmity with the driver of offending vehicle so as to falsely implicate him in the case".
The accident took place on the night of December 17, 2010 when Vikram was going home in Najafgarh on his motorcycle. As he reached near Dwarka, the truck that was being driven in a rash and negligent manner by Dalip Singh, rammed into the bike. Vikram received grievous injuries and was taken to a nearby hospital.
The insurance company had admitted that the truck was insured with it but had taken objection that on verification, the driving licence of the driver was found to be fake and denied its liability to pay any compensation to the victim.
