Additional Sessions Judge Mahesh Chander Gupta sentenced 30-year-old Pintu, resident of Uttam Nagar, to imprisonment for seven years saying it was proved that the child was kidnapped by him.
The court, however, acquitted Pintu of the charges of kidnapping the minor for ransom.
"Prosecution has failed to prove that such kidnapping by accused Pintu was for ransom and he caused disappearance of evidence of offence of kidnapping of child," it said.
"I am of the considered opinion that the ends of justice can be met by sentencing convict Pintu to undergo rigorous imprisonment for a period of seven years and to pay a fine of Rs 20,000 for the offence of kidnapping," the judge said.
According to the police, Pintu had kidnapped his landlord Ravinder Kumar Sinha's son on January 9, 2008 and demanded Rs 50,000 for the child's release.
To mislead the child's parents, Pintu, who stayed in the same house, accompanied his mother when she was going to the police station and insisted her not to lodge the complaint and to pay him Rs 50,000 which he would give to the kidnappers, it said.

He had told the child's mother that he received a ransom call from the kidnappers and assured her to bring the boy back on the payment of Rs 50,000 to him but vanished thereafter.
The prosecution submitted that the accused had committed a serious and grave offence of kidnapping minor child for the purpose of ransom and till date, despite best efforts, the boy could not be recovered.
