DUE TO difficulties being faced by the Toll Tax Department of MCD in implementing the toll tax scheme and to penalise the escaping operators/drivers, the Municipal Corporation of Delhi has notified Toll Tax Bye-Laws.
Under the Bye-Laws, no commercial vehicle shall forcibly enter the National Capital Territory of Delhi either by breaking the Toll Tax barriers or any other structure provided for regulating movement of commercial vehicles in connection with collection of toll tax.
Any driver or operator who forcibly enters the National Capital Territory by breaking the barrier or any other structure put up by the Toll Tax Department will have to pay damages in addition to Toll Tax and penalty.

The penalty provisions state that any commercial vehicle entering the National Capital Territory withpout payment of Toll Tax shall be punishable with penalty equal to the amount ten times of basic rate per entry prescribed for each type of vehicle. Unless penalty is paid, vehicle will remain impounded and will be released only on payment of penalty.
In this connection, Opposition leader in MCD, Mr Ram Babu Sharma has stated that there are three entry points adjoining the Uttar Pradesh border where there are two entry points to Delhi as UP falls in between. He said that in such instances there is likelihood of a commercial vehicle being made to pay ten times penalty, if he passes through the first point without paying penalty. Municipal Commissioner Mr V K Duggal in this connection has stated that arrangements will be made so that toll tax is levied at the first entry point itself rather than the second entry point.
