The two sides clashed at the stage of introduction of the Bill, with the Opposition MPs saying Governors in non-BJP ruled states were acting against the elected governments. Deputy Chairman Harivansh put the motion for the introduction of the Bill to voice vote and declared it defeated. Brittas, however, insisted on a division. The motion was rejected with 56 members opposing it and 21 in favour of the introduction. The lieutenant governor is bound by the aid and advice of the Council of Ministers of National Capital Territory of Delhi in matters within the legislative scope of the national capital, the Supreme Court ruled on Thursday. A five-judge constitution bench headed by Chief Justice D Y Chandrachud said the term administration with regard to powers of the lieutenant governor cannot be understood as the entire administration of Delhi. Delineating the boundary of powers of the LG, the bench, which also comprised Justices M R Shah, Krishna Murari, Hima Kohli and P S Narasimha, said he may act in his discretion only in two classes of matters. Firstly, where the matter deals with issues which are beyond the powers of the Legislative Assembly and where the President has delegated the powers and functions to the Lieutenant Governor in relation to such matter; and secondly, matters which by law require him to act in his discretion or where he is exercising judicial or quasi-judicial functions,

Prime minister or a chief minister does not have disciplinary control over the members of the council of ministers and it is not possible at all times for them to take the whip whenever a disparaging statement is made, the Supreme Court said on Tuesday. The observation by a five-judge Constitution bench headed by Justice S A Nazeer came while delivering its judgement on the issue of freedom of speech and expression of public functionaries. The Prime Minister or the Chief Minister does not have disciplinary control over the members of the Council of Ministers. It is true that in practice, a strong Prime Minister or Chief Minister will be able to drop any minister out of the Cabinet. But in a country like ours where there is a multiparty system and where coalition governments are often formed, it is not possible at all times for a Prime Minister/Chief Minister to take the whip, whenever a statement is made by someone in the Council of Ministers, Justice V Ramasubramanian, who wrote th

Prime Minister Narendra Modi has told all ministers and secretaries not to ignore background notes or other communication shared by National Security Council Secretariat (NSCS) and National Security Advisor (NSA), and to take them seriously, sources said on Sunday.
