Former Chief Justice of India U U Lalit on Thursday said the LGBTQ community is not entitled to claim "vertical" reservations like those given to the Scheduled Castes (SC), Scheduled Tribes (ST), Other Backward Classes (OBC), or Economically Weaker Section (EWS). He, however, said they may claim "horizontal" reservation on the lines of the ones for women and persons with disabilities. When asked whether the LGBTQ community will ever come under the ambit of constitutional affirmative action/reservation, he said, "Theoretically yes, but if I give the counter argument, not to belittle the idea, but to see that my birth in a community like SC, ST or OBC is something beyond my capacity while sexual ...
The Centre, which controls the Kendriya Vidyalaya Sangathan (KVS), is the appropriate government for notifying the annual income threshold to decide whether a child belongs to the economically weaker section (EWS), the Delhi High Court has ruled. It said the KVS cannot deny admission to a student under the EWS category on the ground that the income certificate has been obtained from another state and not from the Delhi government. Justice Anup Jairam Bhambhani said the central government has notified that a certificate for that purpose is to be issued by an officer not below the rank of tehsildar in the state, after carefully verifying all relevant documents and following due process as prescribed by the respective state governments. "This implies that for a candidate applying for admission to a KV school anywhere in the country under the EWS category, they need not furnish a certificate issued from the state government where the school is situated but such certificate is required t

From hearing a plea for EWS and DG seats in schools to refusing to grant a stay on the investigation in Ashneer Grover case, here are important cases of the day
The whole purpose of reservation of seats for Economically Weaker Sections (EWS) and Disadvantaged Category (CG) will be defeated if seats for them in schools are allowed to go waste on account of neighbourhood criteria, the Delhi High Court has said and ordered a school to admit two students who lived some distance away. It said the seats in these categories are limited while the demand is much higher. Therefore, while allotting seats for admission under the EWS or DG category, it may not be possible for the Directorate of Education (DoE) to follow the criteria of neighbourhood strictly, the court said. This court notes that in the present social milieu, the demand for admission under the EWS/ DG category is much higher as compared to the number of seats that are available for allotment under the EWS/ DG category. "Therefore, if seats in a particular school are available under the EWS/ DG category, then the DOE is required to allot such schools to the applicants who have applied

The Jamia Millia Islamia University told the Delhi High Court on Tuesday that it was declared a minority educational institution in 2011 and the provision of 10 per cent reservation for students from the economically weaker section (EWS) will not be applicable to it. The oral submissions were made on behalf of the university in a petition seeking directions to it to ensure 10 per cent reservation for students from the EWS category at the time of admission from the academic year 2023-24. A bench of Chief Justice Satish Chandra Sharma and Justice Yashwant Varma granted two weeks' time to the university to file its reply to the petition and listed it for further hearing on May 22. The sites where these units are to be constructed have been identified and the tendering process will be initiated soon, he said.
