Telecom regulator TRAI on Wednesday intensified its crackdown on pesky calls and messages with new rules that prescribe fines ranging from Rs 2 lakh to Rs 10 lakh for recurring and repeated instances of violation, in cases where telcos misreport the count of such spams. The regulator has mandated all telecom operators to analyze call and SMS patterns based on parameters such as unusually high call volumes, short call durations, and low incoming-to-outgoing call ratios to flag potential spammers in real-time. The amendment in the regulation in Telecom Commercial Communications Customer Preference Regulations come with graded penalty that will be imposed on telecom operators in case they fail to implement the provisions of the rule. For instance, a financial disincentive (FD) of Rs 2 lakh for the first violation, Rs 5 lakh for the second instance of violation and Rs 10 lakh per instance for subsequent violations will be imposed on access providers in case of misreporting of the count
Vast majority of mobile subscribers who took part in a survey have said they receive pesky calls every day with most calls coming for financial services and real estate, online survey firm Localcircles said on Sunday. According to the survey, 95 per cent mobile subscribers confirmed receiving pesky calls every day with 77 per cent getting three or more such calls daily. Besides, vast majority confirmed receiving calls in the last 12 months despite being registered in the Trai's do not disturb (DND) list. As per the survey report, "96 per cent of mobile subscribers surveyed who registered on Do not Disturb (DND) list say they have been getting pesky calls on their number in the last 12 months. Effectiveness of Do Not Disturb (DND) services also reduced as 96 per cent confirmed receiving such calls despite being registered for DND as compared to 90 per cent who said so six months back in the survey done by Localcircles," the survey report said. Amid consumer complaints about pesky calls, TRAI on Tuesday held a meeting and conveyed a strong message to service providers and their telemarketers to take effective measures to curb bulk communications using voice calls. As part of the crackdown, the regulator has sought proactive action from all the stakeholders specially access service providers (telcos) and their delivery telemarketers. The immediate action sought includes implementing technical solutions for traceability and preventing bulk calling by enterprise customers using 10-digit numbers. "The regulator has conveyed a strong message to the service providers and their telemarketers to come forward and take effective measures to curb bulk communications using voice calls," the Telecom Regulatory Authority of India (TRAI) said in a release.
