A sessions court here on Thursday rejected activist Teesta Setalvad's discharge plea in a case of alleged fabrication of evidence related to the 2002 Gujarat riots. Additional sessions judge A R Patel rejected Setalvad's plea. The Gujarat government had opposed her application saying that she abused the trust of the riots victims and implicated innocent persons. On Wednesday, the Supreme Court had granted bail to Setalvad in the same case after the Gujarat High Court denied her relief.

The Supreme Court on Wednesday extended interim protection from arrest to activist Teesta Setalvad in a case linked to the 2002 post-Godhra riots. The next hearing will be on July 19. A bench of Justices B R Gavai, A S Bopanna and Dipankar Datta issued notice to the Gujarat government on the appeal filed by Setalvad against the Gujarat high court order. At the outset, Additional Solicitor General SV Raju sought time from the top court, saying he needs time to translate documents. The bench agreed to his request and posted the matter for hearing on July 19. The apex court on July 1 protected Setalvad from arrest and stayed for a week the high court order rejecting her plea for regular bail and asking her to surrender immediately in a case of alleged fabrication of evidence to frame innocent people in the post-Godhra riot cases.

The court of Justice Nirzar Desai rejected Setalvad's bail plea and directed her to surrender immediately as she is already out of jail after securing interim bail. Social activist Teesta Setalvad has said the country had rarely seen accountability of the state as far as targeted violence is concerned, and added that survivors and citizens supporting them are among the "fallout" of such violence. Delivering the Girish Patel Smarnanjali Lecture here on Sunday, Setalvad said the story of targeted violence begins with the build-up that is created with hate speeches and hate writings. The survivors of such violence have to face difficulties in ensuring punishment for the perpetrators, she added. "What is fallout? State accountability happens rarely in our country. How many people have been punished in (the riots of) 1984, 1992 and 2002? These are the questions before us. Activist Teesta Setalvad walked out of a prison here on Saturday, a day after the Supreme Court granted her interim bail in a case of allegedly fabricating evidence related to the 2002 Gujarat riots. She had been lodged in the Sabarmati Central Jail here since her arrest on June 26. As per the SC order, she was produced before sessions judge V A Rana for bail formalities. "The sessions court imposed two conditions over and above the conditions imposed by the apex court. The sessions court asked the accused to furnish a personal bond of Rs 25,000 and not to leave India without its prior permission," special public prosecutor Amit Patel said.
