"Greater empowerment is required to be given to the competition commission. There should be a provision within the Act itself which binds the government to take CCI's advise on every decision which may give rise to competition issues in the future," Dhall told PTI.
Presently, the Commission can advise the government as per provisions of the Act, but whether the government takes any note of it or not is not known, he added.
"So it should be binding on the government to consult the Commission before passing any legislation," Dhall added.
Last year, CCI had also made a recommendation regarding the same to the working group of Planning Commission on the Competition Policy.

CCI had said, "It is necessary that the Competition Act 2002 should have a provision allowing the CCI to give its opinion suo moto to the government on any economic policy substantially impacting competition within India".
The Standing Committee on Finance of the 14th Lok Sabha in its report had observed that CCI should make "sincere efforts to utilise its expertise to pinpoint such policies of the government, which are inconsistent with the principles of competition".
The provision in other parts of the world like Australia and UK, which have a Competition Law, should also ensure that such advises and government responses are put in public domain, he said.
