With the June 1 deadline nearing to take up the responsibility of clearing large mergers and acquisition deals, the Competition Commission of India (CCI) is busy organising training programmes for its officers.
Experts from abroad have come and held sessions. Officials say the Federal Trade Commission (FTC) of the US would be organising sessions this month. CCI is also joining hands with the Federation of Indian Chambers of Commerce and Industry for another event next month.
The FTC will impart knowledge and experience on the ‘Economic framework for merger review and analysis’ on April 18-21. The session is expected to review the statutory elements of the Competition Act’s provisions on mergers and compare these to the framework established by US merger guidelines.
“By mapping the provisions of the Competition Act on to the guidelines, we will draw out the general convergence between the two frameworks, as well as identify any potential discrepancies. We will attempt to determine how much flexibility CCI has in interpreting the Competition Act, both substantive analysis and process,” an official said.
The seminar will review the best global practices in identifying, collecting and analysing evidence. “We will provide an overview of problems in data collection and pragmatic responses to deficient data productions. We will discuss potential approaches to situations when different sources of information are in conflict with one another,” he added.
