The ruling stops Britannia from making any change in pension fund rules that could decrease the amount of pension. The court has also asked the company to pay their pension according to the January 2003 norms.
The case, filed by the BIL Pensioners Welfare Association (PWA) against Britannia, is expected to be heard in July. The company, last year, had given "an ex-gratia" offer to PWA instead of the original terms and conditions.
The offer did not guarantee the full pension amount due to the pensioners. The company did not answer an email questionnaire.
This is a development after the Calcutta High Court ordered Britannia in December to return Rs 12 crore taken out by the company from BIL Covenanted Staff Pension Fund in 2003.
Due to this, a large of number of officers and managers who retired after April 1, 2003 have stopped receiving pensions. BIL has refunded the amount but the pensioners still haven't received the pensions. Some of these pensioners have passed away.
The members have also filed cases on three grounds at other courts
