SC adjourns hearing on Man's plea against GAIL's re-tendering

The Supreme Court today deferred hearing on Mumbai-based Man Industries' plea challenging GAIL's decision to re-bid for the Dahej-Vijaipur gas pipeline upgrade

project.

A Bench headed by Justice VS Sirpurkar adjourned the matter by a week.

Man Industries has challenged the Delhi High Court ruling that dismissed its plea.

Man Industries, which was the lowest bidder for three out of the four sections of carbon steel bare line pipeline, said that GAIL should be restrained from taking further

steps pursuant to the fresh advertisement in respect of tendering afresh for the pipeline project.

Challenging GAIL's decision to re-tender for the project to take advantage of falling steel prices so as to bring down the project cost, Man in its appeal said that

 

fluctuations in prices of raw material cannot be the basis for nullifying the bidding process.

GAIL had asked the shortlisted steel pipe suppliers to give revised price quotations taking into account the falling steel prices but since the move was challenged by

Man Industries, it decided to cancel the tender and call for fresh bids.
