SC rejects ArcelorMittal plea on arbitration in cargo handling dispute

Two-judge bench holds that trial court can consider application filed under Section 9 of the Arbitration Act by Essar against ArcelorMittal

The Supreme Court has dismissed a petition filed by ArcelorMittal Nippon Steel India Ltd and upheld an earlier Surat commercial court order rejecting the L N Mittal-owned company's request to transfer proceedings over a cargo handling agreement dispute and non-payment with Essar Bulk Terminal to an arbitration tribunal constituted by the Gujarat High Court. The SC bench of Justices Indira Banerjee and J K Maheswari held that the trial court can consider the application filed under Section 9 of the Arbitration Act by Essar against ArcelorMittal.
