Badaun case follow-up: CBI to write to Centre urging better post-mortem facilities

Poor post-mortem leads to wrong conclusions, says agency

Following the Badaun case mess-up where the Central Bureau of Investigation (CBI) has concluded that the two girls found hanging had committed suicide and were not murdered, the agency is writing to the union Home Ministry urging them to upgrade the post-mortem facilities which often lead to "wrong conclusions" in the investigation.

"CBI is proposing to send a report to the union home secretary highlighting the inadequacies in the present post-mortem system and proposing modernization and technical upgradation of post-mortem facilities in states," said a CBI source. This comes in the wake of the wrong conclusion based on the initial post-mortem report that had alleged that the two girls were sexually assaulted and murdered, sources said.

 

The CBI had closed the case on December 11 after finding that the two girls had committed suicide and the allegations against five accused named in the First Information Report (FIR) were false which led to their wrongful conviction by the state police, according to sources. "Based on around 40 scientific reports, CBI has concluded that the two minor girls in the Badaun case had not been raped and murdered as had been alleged in the First Information Report (FIR). Investigation has concluded that it is a case of suicide," the agency had said.

CBI officials had said that the post-mortem conducted by doctors in Uttar Pradesh and the state police investigation were wrong.

A multi-institutional board of directors set up by the agency highlighted short-comings in the post-mortem process, sources said.

"It has come to our notice that the poor infrastructure facilities in several states across the country relates to wrong outcome. The absence of standard police and medical protocol as also the lack of trained doctors, many a times contribute to wrong, weak or incomplete post-mortem report," the CBI will tell the union home ministry, sources said.

In many instances, the accused have walked free as a result of this, a source confessed. The CBI will suggest that this process be made a part of the modernization plan of the state police forces with the support of the ministry of health and family welfare.

Two minor cousin girls, aged 14 and 15, were found hanging from a tree near their village on May 28 which led to a political uproar in the country. The case filed by the state police had alleged that the girls were allegedly sexually assaulted and hanged. Even the post-mortem conducted by the doctors in UP had aligned towards this allegation. The case was handed over to the CBI in June and the agency had filed a closure report before special judge Anil Kumar in Badaun who listed the matter for hearing on January 6.
