The Central Bureau of Investigation (CBI) on Tuesday told the special court it would give Janata Party chief Subramanian Swamy a copy of the documents demanded, by Thursday. Swamy had asked CBI to provide him the transcript of the meeting that took place between the then telecom minister A Raja and former finance minister P Chidambaram, during 2G spectrum allocation.
Swamy told judge O P Saini on Tuesday that CBI was yet to provide him with the documents. He alleged the conversation between Raja and Chidambaram was indicative of complicity between the two political leaders in the 2G spectrum scam. The file being sought by Swamy is regarding the policy on sale of equity (lock-in period) which was seized by the CBI on October 22, 2009, during a probe. He had also moved a petition in the court asking CBI to investigate Chidambaram’s role in the 2G spectrum scam.
The trial court continued with the cross examination of the second witness in the 2G case, A N Sethuraman, Group President of Reliance ADAG. Sethuraman told R N Mittal, senior advocate of accused Shahid Balwa that no equity certificate was prepared by Hari Nair, another accused, in respect of Swan Capital in his presence and that he was shown the document for the first time by CBI. “Since Hari Nair is typed therein, I assumed that it must have been signed by him,” he said.
He also said that he did not tell CBI that equity shareholders of Swan Telecom holding “equity of 10 per cent or more either directly or through its associates do not have substantial equity holding in more than one licencee company in the following service areas for the access service.”
He also said that he had not seen the original memorandum of association and article of association of Swan Telecom and also that he was not aware of any special resolution passed confirming the alteration of object clause of the company.
