Rajasthan HC requests Speaker to defer action on disqualification notices till Friday

The Rajasthan High Court on Tuesday requested the Legislative Assembly speaker to defer action on disqualification notices to dissident Congress MLAs till July 24, the speaker's counsel said. The court also reserved its judgment on the writ petition filed by Sachin Pilot and 18 dissident legislators for July 24.

The high court had on Friday given a four-day reprieve to Sachin Pilot and other Congress dissidents from any action by Rajasthan Speaker on the disqualification notices served on them by extending the hearing into their petition.

Pilot was sacked as deputy chief minister and the president of the state unit of the party after he rebelled against Chief Minister Ashok Gehlot.

High Court verdict will decide Sachin Pilot's fate in Rajasthan politics

Amid the political battle between Chief Minister Ashok Gehlot and former Deputy Chief Minister Sachin Pilot, all eyes are now on the Rajasthan High Court. The court is hearing a case filed by Pilot and will further take up the matter on Tuesday. Sources in the Congress said whichever way the court decision goes, then that camp will have an edge over the other in terms of bargaining, though Ashok Gehlot has the required numbers in the Assembly to prove his majority.

Sources close to the Pilot camp said if the court decision came in their favour, then the Congress leadership might be compelled to talk to Sachin Pilot on his terms, according to an IANS report.

Congress spokesperson Randeep Surjewala when asked about Pilot's "homecoming" said, "The BJP has been exposed for its attempt to topple the elected government, and now they are saying that there is no need for a floor test and the matter of MLAs can be discussed within the party." The Congress Legislature Party held a meeting on Tuesday ahead of the High Court verdict.

"The matter of the family should be sorted out within the family. It cannot be resolved through media channels and Sachin Pilot should immediately stop taking favours from the BJP," said Surjewala.

Rajasthan HC order on rebel Congress MLAs' petition expected; CLP holds meeting

The Rajasthan High Court is likely to pronounce its order on Tuesday on a writ petition filed by Sachin Pilot and 18 other dissident Congress MLAs, challenging the disqualification notices issued to them by the state assembly speaker.

The petition was taken up by a bench of Chief Justice Indrajit Mahanty and Justice Prakash Gupta on Friday and arguments were heard on Monday till evening, but no conclusion was reached. The hearing began at 10:30 am on Tuesday and later, the court directed all parties to submit their written submissions by 2 pm. Senior advocate Mukul Rohatgi, appearing for Pilot and the other Congress legislators, concluded arguments for the petitioners.

The dissident MLAs had moved the court on Friday amid the infighting in the state unit of the Congress, as Chief Minister Ashok Gehlot and his now sacked deputy Pilot tussled for power. The bench also allowed the application of intervener Public Against Corruption (PAC), an NGO, during the hearing. The NGO had filed the application on Monday. A Congress Legislature Party (CLP) meeting also began on Tuesday at a hotel on the outskirts of Jaipur. This is its third meeting in the last one week.
