Bench reserves orders on Jagan, Emaar-APIIC cases

The division bench of Andhra Pradesh High Court, hearing the writ petitions against Kadapa MP YS Jagan Mohan Reddy and Emaar-APIIC deal, on Thursday briefly read out the CBI’s preliminary inquiry reports minutes before reserving its orders. Earlier in the day, the court completed the hearings on counter affidavits filed by the respondents in the two cases.

The counsel representing Jagan and other companies who are respondents in the alleged kickbacks case as well as the counsel for the Dubai-based company had earlier requested the division bench headed by Chief Justice Nisar Ahmed Kakru to provide the copies of these investigative reports before proceeding with the orders.

 

During the arguments, the chief justice told them that their request could be considered only when the court decides to use the reports against their clients. At one point, the judges maintained that the contents of the report need not be shared with the respondents as the preliminary inquiry into the allegations levelled against Jagan and Emaar was purely meant for their own assistance.

However, the chief justice ordered opening up of the sealed covers containing the CBI reports soon after the completion of arguments and briefly ran through the pages minutes before breaking the bench.
