China Tops Anti-Dumping Cases

China topped the list of anti-dumping cases accounting for half of the 30 probes initiated during 2002-03. Of the 153 cases initiated by India since 1992-93, 66 investigations were launched against Chinese imports.

The annual report of the Directorate General of Anti-Dumping and Allied Duties (DGAD) released today said, during 2002-03, China was followed by Taiwan and Korea with six cases each and Singapore with four cases.

Of 153 investigations since 1992, final findings have been issued in 117 cases and preliminary in 18 cases. So far none of the decisions of DGAD had been referred to the WTO's dispute settlement mechanism, it added.

 

The report also said that 82 anti-dumping cases had been initiated against Indian exports and the highest number was by the European Union followed by the US, South Africa and Indonesia.

Of the 32 anti-subsidy cases initiated against India, the EU accounted for 44 per cent of cases followed by the US and South Africa with 19 per cent each.

The highest number of anti-dumping cases continued to be on engineering products, including steel followed by textiles and drugs and pharmaceuticals.

India which emerged as the leading country in using anti-dumping measures in WTO's report for January-June, 2002, also initiated cases against mulberry raw silk, ammonium nitrate, ball bearings and butter oil.

Out of the 30 cases initiated in 2002-03, 11 pertain to chemicals and petrochemicals, five to consumer goods, four to steel and other metals and three to pharmaceuticals. DGAD issued 29 final findings during the year, out of which 28 relate to cases initiated prior to 2002-03, the report said.

It said out of the 153 cases initiated by DGAD, 52 appeals have been filed before Cegat which upheld decision of the designated authority in 26 cases, modified partially in five cases and quashed it in three cases.

The authority has also initiated four mid-term review cases , six sunset review cases and four new shipper review cases in the last financial year.

It also conducted verifications by exporters in 17 cases, while domestic verifications were conducted in 41 cases, the report said.

With the removal of quantitative restrictions and lowering of customs tariff, the number of complaints to DGAD has been on rise which has initiated measures for expediting and streamlining the procedures, the report added.
