The Delhi High Court yesterday dismissed an application by Rashtriya Mukti Morcha (RMM) seeking the courts permission to oppose former premier Narasimha Raos plea for quashing of charges framed against him in the multi-crore MPs bribery case.
Justice Mohammed Shamim, who heard arguments on behalf ofthe RMM on Friday, dismissed the petition saying that in Criminal Procedure Code there is no provision by which a private party could intervene in a criminal proceeding.
The applicant had alleged that the prosecuting agency, CBI, was either not well equipped or trying not to be equipped to oppose applications in the case filed at various stages. It said the case could be unearthed because of the original complaint filed by RMM with CBI and subsequent petition in the Delhi High Court. The petitioner further pointed out that three chargesheets were filed in the case due to the monitoring of the probe by a division bench.
Justice Shamim said, after directions were issued to CBI by the division bench, the role of RMM came to an end as far as the case was concerned.
The judge said there was no force in the application and dismissed it.
Rao has approached court for quashing of the trial court order framing charges against him in the bribery case. The High Court has issued notice to CBI and fixed August eight for hearing on Raos application.
Former Karnataka Chief Minister Veerappa Moily and two of his former cabinet colleagues have also challenged framing of charges against them in the High Court.
