An application filed by the Central Bureau of Investigation (CBI) on Monday, seeking orders to attach the properties of the media firms promoted by Kadapa MP YS Jagan Mohan Reddy, has been returned by the additional chief judge of the city civil court.
The judge raised objections on various counts, including the question of jurisdiction over the application.These objections ranged from pure technical matters like no clear mention of the name of the person who granted permission to the investigative agency on behalf of the state government to the lack of clarity in the application on whether there was any third-party interest already existed on those assets, and the limitations of jurisdiction of the court as the properties of the said firms were also spread out in districts outside Hyderabad.
The CBI counsel, Balla Ravindra Nath, said that the investigative agency would file a report with clarifications and relevant information on the court's objections to take the matter forward. The judge, A Hari Hara Nadha Sarma, allowed one-week time to the CBI to respond to his objections on its application.
The fate of the request for attachment of the properties of the prime accused in the Emaar-APIIC township project case Koneru Prasad and another accused, who was alleged to have been an associate of Jagan in the same case, would also be decided after the CBI answered to the objections raised to its application by the court.
Earlier, the vacation court headed by Sarma, returned the caveat petition filed by Jagan firms seeking the copies of the orders issued under confidential category permitting the investigative agency to approach the court seeking directions for attachment of the assets of media firms.
Meanwhile, the CBI special court on Monday refused to give any directions on the petition to stop the initiation of any trial till the CBI filed all the charge sheets in the ongoing case involving alleged quid-pro-quo deals against Jagan.
