HC adjourns hearing of PIL on civic polls

Karnataka High Court today adjourned hearing of a PIL challenging the notification of State Election Commission (SEC) withdrawing its notification for the Bruhat Bangalore Mahanagara Palike (BBMP) polls, to tomorrow.

When the case came up for hearing before a division bench, additional advocate general K M Nataraj raised objections to the maintainability of the petition. Nataraj argued that in its earlier writ petitions and PILs filed in connection with the case, the court had granted time to BBMP to conduct elections.

He said the SEC move came after the state informed the Commission it required more time to re-work the BBMP reservation list. The Supreme Court, on January 28, 2010, granted liberty to the government and the SEC to approach the division bench for extension of time, he said.

 

Therefore, when the government is contemplating applications in those matters as permitted by the SC, the present PIL, filed by former mayor P R Ramesh and others, cannot be considered independently without considering the applications and knowing the outcome of the orders passed in those matters and hence is not maintainable, the Nataraj argued.

The bench then adjourned further hearing of the case to tomorrow.
