HC extends stay on mill land issue till Aug 31

rks and to mill owner/developer as per the plans approved under the regulations 58 of 1991.  It has asked BMC to furnish details of mills that are being rehabilitated/revived or being modernised under regulation 58 of 1991 and 2001.  The petition alleged that during the development of mill lands, the concerned parties have not followed regulations. As per DCR, part of the sick mill land has to be surrendered to BMC and to MHADA, however, the percentage laid down in the rules are not abided by, the petition alleged.  With regard to Jupiter Mills, the court has permitted NTC to proceed with the sale subject to NTC furnishing an undertaking that it would surrender additional land in its other mills for open spaces, if required by the court.  The government had issued DCR in 1996 and later revised it in 2001. The modified regulation permits reconstruction after demolition of existing structures.  In the revised provision, the lands after demolition of the existing structure would not be available for sharing due to which area available for sharing by BMC and MHADA gets substantially reduced as compared to that which would have been otherwise available under the original DCR, the petitoner said.  Due to this, the area available for open playground and recreation would get reduced. There are 58 cotton textile mills out of which 25 are owned by NTC.  There are around 32 private textile mill lands, Intimation of Disapproval (IOD) has been given to 23 mills and a commencement certificate (cc) has been issued to 20 mills.
