High Court asks Dalmiya to reply to BCCI notice

A division Bench of the Calcutta High Court comprising Justice Bhattacharya and Justice P.N. Sinha today asked Jagmohan Dalmiya, former President of the Board of Control for Cricket in India (BCCI), to answer the show-cause notice issued to him by the present management of BCCI within March, 24, 2006.
 
The Division Bench also set aside the order of seventh judge of the City Civil Court, which restrained the present BCCI board from proceeding with the show-cause notice dated February 27.
 
The present BCCI board issued the notice directing Dalmiya to answer questions about alleged irregularities in the accounts of the Pilcom "" the Pakistan India Lanka Committee "" created for the 1996 World Cup Cricket fund.
 
While setting aside the order of the judge of City Civil Court and allowing the appeal of BCCI, the division bench held that the trial court acted illegally in passing the order of ad interim injunction.
 
The bench further held that the lower court had not followed the preliminary provisions of law in granting interim order. It held that there was no scope for continuing the interim order any further.
 
In the notice dated February 27, 2006, allegations of misappropriation of funds was levelled against Dalmiya. It was not for the civil court to adjudicate the issuance of notice at this stage, the Court held.
