Justice N G Nandi also issued notice to the CBI for October 30 on Advani's petition, seeking the setting aside of the September six order of the special judge whereby he refused the BJP chief's application to discharge him from the case and also directed that charges be framed against him for allegedly receiving illegal gratification from the hawala-dealing Jain brothers.
Senior counsel and former Union law minister Ram Jethmalani appearing for Advani alongwith senior counsel Arun Jaitley contended that V B Gupta's order had led to serious miscarriage of justice.
