The MSEB counsel took objection to the proposal claiming the rules and regulations on the issue of setting up an open access mechanism in the power sector were yet to be put in place.

The Tata Power counsel pointed out that, since till June 10, 2004, power utilities would be operating under the earlier licenses, the proposal was premature.

However, the MERC chairman P Subramaniyam pointed out that the commission was only admitting the BSES petition without going into the merits of the proposal.

BSES is seeking access to the transmission lines of Tata Power and MSEB in a bid to facilitate the import of power from sources other than Tata Power, upon whom its is dependent for servicing a large part of its estimated 22 lakh consumers in Mumbai
