MSEB to file fresh affidavit on Bechtel

The Maharashtra State Electricity Board (MSEB) will be file a fresh affidavit in the "contempt" case pending before the Bombay High Court against Bechtel.
 
The MSEB had secured a stay order against international arbitration and is unfazed by the compensation of $125 million awarded to the Enron-promoted Dabhol Power Company (DPC) stake holder Bechtel by a London court.
 
"Even the earlier financial award issued by a US court against the Maharashtra government and the MSEB was secured by the foreign stakeholders of the DPC after a stay was issued by the high court against any such move. The contempt petition was filed last year. We will file a fresh affidavit against Bechtel," said a MSEB official.
 
The financial award issued by any international court would not be executable in India as it was in violation of the ruling by an Indian high court (Bombay), the official added.
 
"In the event of Bechtel wanting to make the state government and MSEB pay it compensation, it needs to move an execution petition before an Indian court of law," he added.
