Dismissing opposition reservations that appointing a judge before May 16 to investigate into Gujarat 'Snoopgate' will be violation of the election code, Union Law Minister Kapil Sibal today said the question does not arise as the probe commission was set up long before the Lok Sabha polls.

"We set up the Snoopgate probe commission long ago. So appointing a judge before May 16 will not be a violation of the model code of conduct for the polls. He or she will be appointed and you will get to know the name when it happens," Sibal told reporters here.

Sibal's assertions was in furtherance to his statement early in the day that the UPA government will name a judge for investigating the Gujarat 'snoopgate' before May 16.

Sibal was here as part of the election campaign in favour of Congress candidates in the last two phases of Lok Sabha polls in Bihar.

Attacking BJP leaders Arun Jaitley and Ravishankar Prasad for jumping in defence of Narendra Modi in snoopgate, Sibal said, "Jaitley seems has permanent 'vakalatnama' of Modi and Amit Shah. I can't say anything to Ravishankar as it is very difficult to teach him law.
