Airlines are under no obligation to issue duplicate tickets or refund the airfare if the ticket gets lost

If you lose a demand draft or misplace a dividend warrant, you can ask for a duplicate. A duplicate share certificate can also be obtained if the original is lost, after complying with the prescribed formalities.

This rule, however, does not apply to the loss of air tickets and no airline will issue a duplicate ticket or refund the air fare if the ticket gets lost.

This was not the case a few years ago. Take the case of Commercial Manager, Indian Airlines, Calcutta vs S N Mukherjee (1992).

 

Mukherjee had purchased three tickets from Indian Airlines. He lost the tickets and the airline declined to issue duplicate ones.

In a complaint filed before the consumer court, Indian Airlines was directed to refund the sum of Rs 7,212 paid by Mukherjee for fresh tickets.

The West Bengal State Commission also upheld this view and, in addition to the refund of the amount, it awarded a sum of Rs 3,000 as cost of litigation to Mukherjee, holding that this
