Blake Shelton just got closer to his victory in the legal battle against Touch magazine.
Sources revealed that the judge squarely rejected the magazine's bid to have the case thrown out and he even scoffed at the editor's assertion that they never wrote that the 39-year-old singer was in rehab, reports TMZ.com.
The judge also said that the false claims by the magazine are libelous.
During the session Shelton was asked to show the headline that was run by the mazagine as it can be a powerful proof of malice.
The case will now proceed to trial.
