Sambit Gopal, the lawyer representing BJP leader Amit Shah, said on Wednesday that the court will examine the CDs' of his client's recent speeches in Uttar Pradesh, and then only decide whether he should be arrested or not.

"We have challenged the two FIR's that were lodged against Amit Shah that were registered against him where allegations were levelled against him that he has given inflammatory speeches in Muzaffarnagar, Shamli and Bijnore. The court has asked for the CDs' tomorrow to verify the claim, and whether there should be any case pursued against him. Till that time, we have approached the Allahabad court to put a stay in his arrest," Gopal said.

Shah moved court after the Election Commission on Monday issued a notice to him for prima facie violation of the Model Code of Conduct (MCC).

It asked Shah to explain within three days as to why action should not be initiated against him for violating the MCC through his speeches made while campaigning in Shamli, Bijnore and Muzaffarnagar districts of the state.

Last Friday, Shah had met leaders of three communities - Gurjjars, Rajputs and Dalits - at a farmhouse in the town's Gandhi Colony. He apparently spoke of revenge.

"A man can live without food or sleep. He can live when he's thirsty and hungry. But when he's insulted, he can't live. We must seek revenge for the insult heaped on us," he said.

He did the same thing a day before on Thursday while meeting leaders of the Jat community at Raajhar village, 40 km from Muzzaffarnagar and delivered a similar vengeful remark.

"This election is about voting out the government that protects and gives compensation to those who killed Jats," Shah said.

"It is about revenge and protecting honour." he said.
