The Supreme Court has ruled that employees can't claim voluntary retirement scheme (VRS) benefit as matter of right.
A bench headed by Chief Justice Altamas Kabir said that the decision-taking power lies only with the employer firm.
The exception will be only in cases where the scheme itself provides for retirement to take effect when the notice period comes to an end.
The observation came in a verdict relating to the termination of C V Francis, a Kerala resident from Steel Authority of India at Bokaro in Jharkhand.
