The Inter Services Intelligence (ISI) has reportedly asked for a private counsel in missing persons' case indicating distrust over the Attorney General for Pakistan (AGP).
According to the Nation, the additional AGP Tariq Khokhar, on behalf of ISI Director Muhammad Irfan submitted a statement about ISI's demand of engaging a private counsel in missing case of two brothers Umar Bakhat and Umar Hayat from Chakwal.
The statement indicated that both the persons were not in the custody of ISI, however, the police have already informed the court that both persons are being detained under the custody of ISI.
The court made it clear that notice was not issued to ISI as they had always served notices to the Federation through defence ministry and added that the ministry may produce his own counsel.
The report said that the Military Intelligence (MI) had already hired a private counsel Ibrahim Satti in missing person case and he had objected that the court and police had no jurisdiction to proceed against serving army officials.
However, the AGP Munir A Malik said that there is no provision in the Army Act, Criminal Procedure Court and Pakistan Penal Code that bars initiating legal proceedings against the serving army officers.
The court has asked the AAGP that now the federal governments should evolve a comprehensive policy after taking input from concerned departments, and later adjourned the case till July 26, the report added.
